Since no tangible benefit was ever shown in Gupta’s case nor any quid pro quo established, this is significant.

  May 2015 Gupta files new appeal on the basis of United States v. Newman, arguing that under the standard of benefit defined by Newman, the judge in his trial improperly instructed the jury that benefit did not have to be tangible

  July 2015 Judge Rakoff rejects Gupta’s claim that his case is appealable based on the Newman ruling, ruling that his conviction still stands

  Aug 25, 2015 Gupta files new appeal against Rakoff’s ruling

  Jan 5, 2016 Gupta released from jail

  Feb 2016 Second Circuit Appeals Court agrees to hear Gupta’s appeal on the basis of Newman
