  19. Donald J. Trump Tweet, June 22, 2017 (“With all of the recently reported electronic surveillance, intercepts, unmasking and illegal leaking of information, I have no idea … whether there are ‘tapes’ or recordings of my conversations with James Comey, but I did not make, and do not have, any such recordings.”); Stephen Collinson, “Trump ends his self-made crisis where it started: Twitter” (CNN, June 23, 2017).

  23. FBI Director James Comey’s Testimony before the Senate Judiciary Committee (May 3, 2019) (questioning by Senator Patrick Leahy (D., Ver.)).

  26. Kelly Cohen and Diana Stancy Correll, “Rosenstein rejects report saying he talked about getting rid of Trump with 25th Amendment” (Washington Examiner, Sept. 21, 2018).

  27. The president has claimed that one of these candidates was Robert Mueller, who is said to have interviewed for the job a day or so before Rosenstein named him special counsel. In the obstruction volume of his final report, Mueller appears to refute this claim. According to then-presidential adviser Steve Bannon, Mueller was invited to the White House to give the president advice about the FBI as an institution. By law, Mueller is not eligible to serve as FBI director, and Bannon said he did not come looking for the job. Mueller Report, Vol. II, pp. 80-84; Sonam Sheth, “One paragraph in the Mueller report refutes Trump’s claim that Mueller asked him to be FBI director” (Business Insider, May 30, 2019).

  28. McCabe recorded Rosenstein’s suggestions in memoranda on which the Times reported. McCabe repeated the allegations in a later 60 Minutes interview. The FBI’s then-general counsel James Baker was consulted at the time and confirmed the incidents in congressional testimony. “Andrew McCabe: The Full 60 Minutes Interview” (CBS News, Feb. 17, 2018); Nicholas Fandos and Adam Goldman, “Former Top F.B.I. Lawyer Says Rosenstein Was Serious About Taping Trump” (New York Times, Oct. 10, 2018).

  29. Michael S. Schmidt, “Comey Memo Says Trump Asked Him to End Flynn Investigation” (New York Times, May 16, 2017).

  30. The Mueller investigation alleged eleven potential episodes of obstruction, though it did not determine if any of them was worthy of prosecution. I do not believe they are, but addressing them is beyond the scope of this discussion—a question for another day. For now, we are considering the two episodes that were under consideration at the time Rosenstein appointed Mueller: the firing of Comey, and weighing in on the investigation of Flynn. See, e.g., Bill Barr, Memorandum to Deputy Attorney General Rod Rosenstein and Assistant Attorney General Steve Engel, “Mueller’s ‘Obstruction’ Theory” (June 8, 2018); Andrew C. McCarthy, “It Would Still Be Foolish for Trump to Talk to Mueller” (National Review, April 7, 2018); David B. Rivkin and Lee A. Casey, “Can a President Obstruct Justice? Yes but not by doing any of the things we know Trump to have done.” (Wall Street Journal, Dec. 10, 2017); Anna Giaritelli, “Alan Dershowitz: You cannot charge a president with obstruction of justice for exercising his constitutional power” (Washington Examiner, Dec. 4, 2017).

  31. Though adamantly opposed to the appointment of a special counsel, I too attested to Mueller’s credentials. Andrew C. McCarthy, “Robert Mueller: A Solid Choice for Trump–Russia Investigation ‘Special Counsel’” (National Review, May 18, 2017).

  32. Mueller Report, Vol. II, pp. 78-80.

In September 2018, Jody Hunt became the Assistant Attorney General in charge of the Justice Department’s Civil Division.
