  FBI Special Agent Barry Black met me at the Will Rogers World Airport and whisked me straight to the medical examiner's office. Oklahoma City Chief Medical Examiner Dr. Fred Jordan and his colleague Dr. Larry Balding welcomed me and showed me into their autopsy suite, where the mysterious leg was waiting.

  “It's up to you now, Emily,” Barry told me. “I'll check back with you in about an hour and see how you're doing.”

  I took a deep breath and thought for a moment of the 168 lives that had been lost in the bombing, and of Timothy McVeigh and Terry Nichols, who were now in custody and charged with that crime. Then I put all thoughts of crime out of my mind and began examining the leg. Until I had finished this task, I was solely and purely a scientist.

  The Oklahoma City case had begun on the morning of April 19, 1995, when hundreds of people were busy inside the Murrah Federal Building. Some of them were federal agents, but most were civilians, working for federal agencies, mopping the floors, or maybe even filling out applications for those jobs. Visitors in the building were applying for Social Security benefits or filling out passport applications or dropping their kids off for a day of supervised play at the day-care center housed in the building's front corner.

  Then, at 9:02 a.m., a massive truck bomb exploded just outside, destroying the building. Emergency teams launched a massive rescue and recovery effort and managed to evacuate hundreds of injured and frightened victims, but after the dust settled, 168 people were still unaccounted for, including 19 children. Fifteen of those children had been at the day-care center. The other four had been inside with their parents.

  An investigation of the crime began immediately, even as the medical examiner started an all-out effort to find and identify the bodies and body parts that remained within the building. Meanwhile, the FBI called in the forensic anthropologists at the Smithsonian Institution and AFIP. This was, after all, a terrorist act and a mass homicide, so the FBI's concerns went way beyond simply identifying the victims. They wanted to recover and document every piece of evidence so that they could use it to prosecute whoever was responsible for this terrible crime.

  The medical examiner's office also had the services of Dr. Clyde Snow, a world-famous forensic anthropologist who had served for many years as their consultant. When the widely respected Dr. Snow wasn't in South America investigating the deaths of “the disappeared”-victims of the death squads in Argentina's political wars in the 1970s-he was handling cases for the medical examiner, and he began working nonstop to help identify the victims. With the invaluable assistance of the entire medical examiner's staff and local rescue workers, investigators had managed to recover and identify all but three of the victims by the end of May.

  When I heard about their efforts, I had a sudden image of how painful the death analyses on those victims must have been. Many of the people investigating these deaths lived in and around Oklahoma City -as did the victims. Very likely, the people dealing with the remains were looking at the torn and broken bodies of people they knew-colleagues, neighbors, friends. I had never had to perform an autopsy on someone I had even met, let alone become close to, and I could only imagine how painful such an experience would be.

  By the end of May, recovery workers had pulled so much rubble out from the base of the bombed-out building that engineers felt it wasn't safe to continue digging. They believed that the bodies of three victims still remained in the building-but the only way to get them out was to implode the building, to avoid the danger of it collapsing on the rescue workers. Then workers would dig their way through the rubble to recover the remaining bodies. Of course, the imploding building might further damage the remains. But that was a chance they would have to take.

  Although they couldn't reach the bodies, investigators already had a pretty good idea of where they were. So on May 29, they applied some brightly colored spray paint to the area they could reach and backed out to allow the engineering experts to bring down the rest of the building. Hopefully, the spray paint would help lead them to the right portion of the rubble once the building went down.

  And indeed it did. After the implosion, rescue workers quickly found the three remaining bodies and pulled them from the rubble. At the bottom of this massive pile of rubble they also found a portion of a decomposed leg. But no one could match this leg to any of the bodies that had already been recovered.

  Meanwhile, the search for the perpetrators had continued. Within two days of the bombing, an observant state trooper pulled over a yellow Mercury because it didn't have a license plate. The driver, Timothy McVeigh, was arrested about eighty miles north of Oklahoma City and put in the local jail for a number of reasons unrelated to the bombing: because he didn't have a license plate, or proof of insurance, or a license for the concealed pistol the trooper spied hidden under his arm. Just moments before McVeigh was scheduled to be released on bail, investigators sharing information via state computer links connected him to the Oklahoma City bombing, so his jail time was extended until the FBI could explore this connection. Soon a federal grand jury had indicted McVeigh for the bombing of the Oklahoma City Federal Building.

  People who knew McVeigh described him as a white supremacist and advocate of the right-wing militia movement. Investigators soon concluded that McVeigh was responsible for the bombing-but he hadn't done it by himself. Police eventually arrested and charged Terry Nichols, another alleged white supremacist and militia supporter.

  McVeigh was headed for trial, where his team of lawyers was likely to suggest that yet another person had been involved in the bombing-a man who soon became known as John Doe #2. Before McVeigh was arrested, the police had found an axle from the rented Ryder truck that had held the bomb. They managed to link the truck to a Ryder rental agency in Kansas, where they interviewed the rental clerks involved. Clerks told police that they thought they'd seen two men together. John Doe #1 turned out to be McVeigh. But who was the mysterious John Doe #2? It probably wasn't Nichols. He reportedly was hundreds of miles away at the time. So McVeigh's lawyer tried to suggest that this third man-who has not been found to this day-was the real mastermind behind the bombing, with McVeigh and Nichols merely his pawns.

  Then lead defense attorney Steven Jones found out about the mysterious “extra leg.” In his book about the trial, Others Unknown, he claims to have made this discovery by accident, sometime during the summer, when an Oklahoma state trooper leaked the information to him. Jones, in turn, leaked the story to the Dallas Morning News and to Time magazine. Time publicized the fact that an “extra” unidentified leg existed and, suddenly, this body part became the focus of a nationwide controversy.

  Jones claimed that the leg could be helpful to his case, as it might have belonged to the “real” architect of the Oklahoma City bombing. According to him, federal prosecutors had deliberately-and improperly-withheld from him information about this leg, which he argued belonged to a White man wearing military combat gear.

  In fact, the forensic experts had initially thought that the leg was from a White man, but they weren't absolutely certain. They weren't being evasive-they simply couldn't tell for sure. Since the limb had been discovered, it had been analyzed first by experts in the Oklahoma City medical examiner's office and then by FBI specialists from Washington, D.C. At both levels, forensic scientists found a certain amount of ambiguity in the evidence that caused them to revise their findings.

  A few things were certain. Experts determined that the leg had been traumatically amputated about six inches above the knee-presumably by the explosion itself. They also found evidence that the limb had been very close to the epicenter of the initial explosion. Blue plastic shards, which looked as if they might have come from the blue plastic drums that held the explosives, had been driven deep into the bone by the force of the blast. The foot was dressed in two pairs of dark socks and a black combat-style boot, with a military-style blousing strap at the top of the boot-the kind of device used to secure the cuff of a soldier's trousers.

nbsp; The clothing certainly seemed more likely to be worn by a man than by a woman-but some women do wear combat uniforms. The bone data seemed ambiguous as well: the leg might have come from either a robust woman or an average-sized man. Anthropologists commonly depend on the statistical probability that men's bones are larger than women's, but because of the variations inherent in humankind, these probabilities are little more than good statistical guesses. There are no hard-and-fast rules that can positively divide the sexes based on bone size alone.

  Sometimes you can use other indicators, but they're not terribly reliable. Death investigators will duly note whether leg hairs have been shaved-but not all women shave their legs, while some men do. Polished toenails are a more reliable indicator of sex, although many women don't paint their nails-and again, some men do. In this case, the initial evidence did not add up to a single, definitive picture of this individual's sex.

  Nor could investigators be certain about race. The leg had been damaged from the blast and was partially decayed. Since it had lain in the rubble for several weeks, its skin had already decomposed somewhat and begun to discolor. The skin was generally light-colored-but did that indicate that the body was Caucasian or only that the epidermis had sloughed off? Some areas of the skin were slightly darker than others-but was that from natural pigmentation or darkening due to decay?

  Although investigators could see the leg's skin color for themselves, they understood that such visual cues are a highly unreliable indicator of racial identity. Color often changes during the decay process, and in our multicolored United States, people of all different hues identify as “White” or “Black,” with some White people's skin visibly darker than that of people who call themselves African American.

  Since the evidence was ambiguous, the Oklahoma City experts released inconclusive results, finding that the leg had probably belonged to a Caucasian, with a 75 percent chance of its being male, and a 25 percent chance of its being female. But they also sent tissue and hair samples to FBI specialists in Washington, D.C.

  The FBI experts began to revise the initial results, though they, too, were reluctant to issue a definitive report, given the ambiguity of the evidence. The FBI's tests concluded that this individual was probably not male but female, not White but Black.

  Their findings were based on a number of factors, including the dark hairs found on the leg. But they knew very well that it's hard to determine a racial identification from leg hairs alone-scalp hairs tend to be a more reliable indicator. Of course, if the leg hair had been naturally blond, they could probably have concluded that the person was Caucasian. But people of all races have black or dark-brown leg hair.

  Had the leg not been amputated, they might have been able to look at the anterior curvature in the shaft of the femur, which, as I had learned in grad school, is a fairly reliable indicator that can be used to separate Whites and Blacks. In this case, though, the femur stopped just above the knee. Then Dr. Ubelaker and Dr. Snow remembered the paper I had written on racial elements in the bone structure of the knee-and that's where I came in.

  Meanwhile, the defense was making as much as possible of the leg's discovery. Thinking they might be able to blame the entire incident on this enigmatic leg, they began very early in the investigation to refer to it as the leg of the “real bomber.” They went back to the initial reports about John Doe #2-who had been reported as a husky dark-haired man wearing a baseball cap. This mystery man, the lawyers argued, was the culprit who deserved the death penalty, not their client.

  Jones and his defense team built up an elaborate defense based on this mystery leg. First, they pointed out, the leg had been found at the epicenter of the blast-the most likely place for the “real bomber” to be. Second, the initial forensic exam had indicated that the leg had probably belonged to a White male-the most likely profile for such a bomber. Since the bombing seemed to be the work of white supremacists and militia supporters, it seemed highly unlikely that either a Black person or a woman would have been the “real bomber” in such a crime-if only because it was so unlikely that McVeigh would ever have taken orders from anyone other than a “superior officer,” who in the ranks of the right-wing militia would most likely be a White man.

  Thus, when the FBI issued their second opinion, suggesting that the remains were more likely those of a Black female, the defense called this a transparent attempt by the federal government to win its case against McVeigh. The FBI's laboratory analyses were under particular scrutiny because, ever since the O. J. Simpson case, whistle-blower Dr. Frederick Whitehurst had been accusing the Bureau of falsifying laboratory results in favor of prosecutors.

  Besides, the defense pointed out, the leg couldn't be linked to any of the victims who had been recovered and identified. If there was in fact an “unknown” victim, he or she must have been someone who didn't belong in the Federal Building -further suggesting that the leg belonged to the “real bomber.”

  So a great deal of the case came down to the mysterious John Doe #2, the husky dark-haired White male in a baseball cap whom several witnesses had claimed to see with McVeigh in the days before the bombing. The defense was doing everything it could to prove that this leg belonged to John Doe #2, while the prosecution was working hard to prove that it didn't. The defense seemed to be ready to accuse the prosecution of falsifying results so that it could cover up the identity of the “real bomber” and convict McVeigh in his place.

  That's why determining the race and sex of this leg became such an issue. A high-level group of people, including Clyde Snow and experts from the medical examiner's office, the FBI, and the Smithsonian, held a daylong meeting to determine their next course of action. At the end of that day, they called me at my office in Frankfort, Kentucky.

  Dr. Doug Ubelaker, the FBI's top forensic anthropology consultant at the Smithsonian, explained the problem. He'd just read my article in the Journal of Forensic Sciences announcing my discovery of the racial variation in the intercondylar notch of the femur. After he'd discussed my research with the others, they all agreed to invite me out to Oklahoma City to apply that theory to their mystery leg. The FBI would pay all my expenses-but they needed me as soon as possible.

  Of course, I was flattered and said I'd do what I could to help. After checking with my employer, I called back the next day and agreed to fly out. After just a few hours in the air, I got to the medical examiner's office and was first introduced to Dr. Larry Balding, the Oklahoma City forensic pathologist who had done most of the analysis of the parts found in the building, and the one with whom I would be working. I had enormous respect for him, Chief Medical Examiner Dr. Jordan, and of course Dr. Snow-all of these people were heroes in my eyes, and I thought it might be a bit unnerving walking into a strange morgue and working with them on such a high-profile case.

  But the sounds and smells of the morgue were reassuringly familiar. I'd been on staff in Kentucky for more than a year, and by now an autopsy suite was home ground. I spent a grueling but satisfying day examining every inch of the leg, analyzing tissues, measuring x-rays, and taking detailed handwritten notes.

  As the day wore on, Dr. Balding, Barry, and some of the other FBI agents began hovering over my shoulder, eager to hear some preliminary conclusions. I was reluctant to do my standard “thinking out loud” until I was pretty sure of what I was seeing, though, because this case was complicated and controversial enough already. The last thing I wanted was for one of these high-level people to take down a premature conclusion and begin to run with it, only for me to have to tell them at the end of the day that I had changed my mind.

  But by the end of the afternoon, I was ready to go on the record. I called the other investigators together and shared my opinion that this leg had belonged to a woman-a woman who was undoubtedly Black. At this early stage in my investigation, I told them, much of my conclusion was not based on peer-reviewed research. Rather, it grew out of my experience of observing thousands of knee reconstructions and repairs on
athletes from all racial groups, and from dissecting and analyzing literally hundreds of amputated legs at the Hughston Clinic. However, just as I had that late night in Dr. Bass's lab at the University of Tennessee, I just knew.

  Of course, in my written report I'd follow Bass's teachings and limit my conclusions to facts and figures that would stand up in court. Even so, I had enough solid scientific information to corroborate the FBI's determination that this individual was female, with a significant amount of Negroid ancestry. We agreed that I'd return to the morgue the next morning to continue documenting my findings. By the next afternoon, I'd be flying back to Kentucky.

  Barry offered to drive me to my motel, and as soon as we were on the road, we returned to an engrossing discussion of this case that fascinated both of us. I was looking straight at him, absorbed in my explanation of why I could only include the scientifically sound material in my written report, leaving out the impressions I got from feeling and seeing subtle contours in the bones, ligaments, and menisci.

  Suddenly, out of the corner of my eye, I saw a flash of blue-then my head and shoulders whipped left and then right-and then things simply went dark. Either I blacked out from the force of the whiplash, or else I'd closed my eyes in reflex. The next thing I saw was open air on our right as we teetered on the brink of an overpass while the huge tractor-trailer rig on our left slammed against us a second time, ripping into the steel at Barry's shoulder.

  By now Barry's car was up on its right side, skidding along on two wheels, and I was looking straight down into what seemed like an abyss. I just knew we were going to die.
